Senate OKs new tax credit closing deadline
Backers of amendment cite backlog of 180K homebuyers

The Senate has amended a bill to give homebuyers who were under contract on a home purchase by April 30 an additional three months to close the deal and claim the federal homebuyer tax credit.

Extending the deadline for closing from June 30 to Sept. 30 would allow lenders more time to clear a backlog of 180,000 homebuyers nationwide, said amendment sponsor Sen. Harry Reid, D-Nev.

The vote was mostly along party lines, with only four Republicans in favor and one Democrat opposed.

"While I am disappointed that more Republicans did not support this common-sense measure to strengthen the economy and reduce the deficit, I am committed to ensuring that more Nevadans and Americans can become homeowners and that this amendment becomes law," Reid said in a HYPERLINK "http://reid.senate.gov/newsroom/pr_061610_homebuyersextensionpassage.cfm"statement.

The House passed an earlier version of the bill in December, and the Senate approved its own version in March. The Senate is currently working on resolving differences between the two bills.

The National Association of Realtors supports the amendment, saying Realtors have reported that as many as one-third of qualified applicants have been told by lenders that their loans will not close before June 30 because of the sheer volume of loan applications in the pipeline.

The amendment does not extend the deadline for homebuyers to qualify for the tax credit, NAR said in urging lawmakers to approve it, but simply extends the deadline for closing transactions already in contract.

"Since these applications were already in the pipeline and figured into the program's cost, the extension of the closing deadline should not incur any further government costs," NAR President Vicki Cox Golder said in a HYPERLINK "http://www.realtor.org/press_room/news_releases/2010/06/extension_senate"statement.

There has been some speculation that some homebuyers will attempt to submit fraudulent claims for the tax credit by backdating documents showing they were under contract by April 30, and that extending the deadline for closing would expose the government to more fraudulent claims.

Recently a female REALTOR® in Point Loma was contacted by a man named “Charles” who said he was relocating to San Diego from Vermont. He described himself as a widower and firefighter, and told the agent he would be paying cash for a home anywhere coastal in San Diego up to $2.25 million with at least 2,500 square feet, views, and privacy. When the agent requested more information, “Charles” e-mailed back, providing only a cell phone number. The agent did some additional research and discovered a “REALTOR® Safety” article that described a scam whereby someone disturbingly similar to “Charles” has been luring female agents to vacant properties. Congress Abandons Critical Housing Programs – Again

Realtors have been urging Congress to pass a comprehensive National Flood Insurance Program reform bill all year. We conducted a Call for Action in April, testified at Congressional hearings and urged action during our midyear hill visits. Yet once again, Congress left town before reauthorizing the NFIP and the Section 502 Rural Housing Program. As a result, thousands of transactions have come to a stop, again. 

The NFIP and the Section 502 Rural Housing Program are critically important to Americans and the U.S. economy. The real estate recovery can’t afford prolonged Congressional inaction. 

Regardless of your location, rebuilding our markets in every corner of America is in every Realtor's interest. The Realtor Party must speak with one voice to urge Congress to renew both NFIP and the Rural Housing 502 program today. Please contact Congress today.

Congress left for the Memorial Day recess, leaving two critical housing programs unauthorized or unfunded. On May 31, authority for the National Flood Insurance Program (NFIP) expired. Lenders have stopped accepting applications for the Section 502 rural housing program, which has exhausted its funding.

Until Congress returns and extends these programs, worthy homebuyers will be left without access to mortgages. Given the many challenges financial and real estate markets are facing, now is not the time to create another, but avoidable, obstacle to real estate transactions. Please do not let this continue.

As a Realtor, I understand the importance of these programs to every region of the nation. A real estate recovery can't survive the uncertainty created by Congressional inaction.

Rural families in every state in the nation rely on the Section 502 single family guarantee program to allow them to repair, renovate and purchase homes, as well as prepare sites with water and sewage facilities.

Today, property owners in every state depend on these programs. Each day the Congress fails to act, thousands of real estate transactions will be delayed and homebuyers and homeowners will be left in the lurch. Upon your return, Congress must swiftly take the necessary steps to ensure the continuation of these critical and essential insurance programs.

What's At Stake:

Until Congress extends NFIP, no new or renewal flood policies can be issued. Without the flood insurance coverage provided by NFIP, thousands of residential and commercial transactions are on hold. 

Congress has also abandoned the Section 502 Rural Housing Program. The housing program provides zero-downpayment mortgages to eligible families in rural area of every state.  Many of these families signed contracts before April 30th and plan to utilize the homebuyer tax credit.  If this program is not restored soon, they will lose their chance.

This is just a note to remind everyone about the changes found in the Definition Section 22 of the RPA revision 4/10.

"Days" means calendar days.  However after Acceptance, the last day for performance of any act required by this agreement (including Close of Escrow) shall not include any Saturday, Sunday, or legal holiday and shall instead by the next Day.

This is changing the timing for many listing agents on severing a notice to perform.
